Insurance Block Exemptions
The IBER exempts certain categories of agreements, decisions and concerted practices in the insurance sector on anti-competitive grounds with the application of article 101 (3) of the Treaty on the Functioning of the European Union.
The Regulation grants an exemption to the application of competition rules to certain types of agreements in the insurance sector, namely agreements on:
- Joint compilations, tables and studies
- Co-(re)insurance pools (common coverage of certain types of risks)
Although it is arguable whether the work of RISCAuthority is, or was ever intended, to be covered by IBER its existence does offer some protection.
The current IBER is set for review in March 2017 and as part of that process a consultation programme amongst RISCAuthority members has now begun.
This project will form the basis for an official and robust RISCAuthority response to the IBER review and will look to incorporate comment and recommendations from the ABI and Insurance Europe.
